1. Acceptance
By creating a Careward account or using the Careward platform, your practice agrees to these Terms of Service. If you do not agree, do not use the service.
2. Description of service
Careward is a post-visit patient follow-up platform for procedure practices. It structures pathway content, runs check-ins with patients, and routes flagged responses to clinical staff. Careward does not provide medical advice, diagnosis, or treatment.
3. Accounts and access
Access to Careward is approval-gated. Each practice designates an admin user who is responsible for managing team access, role assignments, and removing members who leave the practice.
4. Practice responsibilities
Practices using Careward are responsible for:
- The accuracy of pathway content they configure or approve.
- Their own HIPAA compliance and other applicable privacy obligations.
- Obtaining patient consent for SMS and mobile-web communication.
- Using Careward within applicable medical, telehealth, and consumer-protection laws.
- Ensuring flagged escalations are reviewed by appropriate clinical staff promptly.
5. AI and output disclaimer
Careward supports follow-up workflows. Practices remain responsible for pathway content, patient consent, escalation review, and clinical decisions. AI outputs are drawn from practice-approved pathway content and are not medical advice. All clinical judgment remains with the practice's licensed professionals.
6. Prohibited uses
Practices must use Careward in accordance with the Acceptable Use Policy. Violation may result in immediate suspension.
7. Fees and billing
Careward is sold on a monthly subscription, billed per location. Payments are processed by Stripe. Subscriptions can be cancelled at any time and take effect at the end of the current billing cycle. See the Refund & Cancellation Policy for details.
8. Data and privacy
Our handling of practice and patient data is described in the Privacy Policy. A Business Associate Agreement is available on request before any protected health information is transmitted through the platform.
9. Limitation of liability
To the maximum extent permitted by law, Careward's total liability arising out of or related to the service is limited to the fees paid by the practice in the three (3) months immediately preceding the event giving rise to the claim.
10. Indemnification
The practice agrees to indemnify and hold Careward harmless from claims arising out of misuse of the platform, including non-compliant clinical workflows, unauthorized patient enrollment, or violations of the Acceptable Use Policy.
11. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
12. Modifications
We will provide at least 30 days' notice by email to account holders before any material change to these terms takes effect.
